Abstract
This research aims to answer the basic considerations of judges in imposing sentences on perpetrators of theft with weighting and the decision of the judge at the Bengkulu City District Court for the perpetrator of theft with weighting has fulfilled the facts at trial. The method used in this research is a normative juridical and empirical juridical approach. The data collection techniques used were literature study and field study. The results and discussion are the results of research that judges before deciding on a decision on a case, consider things namely juridical considerations, sociological considerations and elements that have been proven at trial. Juridical considerations Article 184 Paragraph 1 of the Criminal Procedure Code (which hereinafter referred to as the Criminal Procedure Code) that valid evidence is witness testimony, expert testimony, instructions and defendant testimony. Sociological considerations that the defendant behaved well and was frank during the trial. The judge decided on Case Decision Number: 352/PID. B. 2023/PN. BGL in Article 363 Paragraph (1) 3rd and 5th of the Criminal Code and Law Number 8 of 1981 concerning Criminal Procedure Law as well as regulations per the relevant Laws and sentences the defendant to a criminal 2 years in prison by determining that the evidence is 1 (one) piece of blue Gabrielle brand Levis pants, 1 (one) wooden stick approximately 1.5 meters long, blackish brown (seized for destruction), 1 (one) box of Vivo Y 50 Starry brand cell phones Black No. Imei1: 862101043160798, Imei2: 862101043160780, 1 (one) Vivo Y 50 Brand Cellphone Unit Starry Black Color No. Imei1: 862101043160798, Imei2: 862101043160780.
